Through Copyscape, today I discovered that a hospital site in India has stolen two pages from my site and is using the content for a continuing education program which they charge for. They not only stole the content word for word, but stole the images (about 2 dozen of them) which I paid to have created.

I don't think slapping their wrists is good enough. I want to be compensated for the 9 years they have been using my stuff.

My first thought is to ask for compensation. If I get it, then I let it go and they take down the content. If I don't get compensation, then I file DMCA with Google.

Any thoughts?

Sorry to hear that - really frustrating. I think your suggested approach is good. Contact them first and then take further action if they don't respond appropriately.

Does google check who had the content before. As in, whose origination date was first

No, they don't check.

We have a competitor who claims that he has been doing what he's doing since 1997. We have been in our business since 1998 and know for sure that he didn't start plagiarizing our stuff until about 2002, and his domain registration confirms it. His product pages also claim to do our stuff which he has no way of doing.

Google gives his site top page rank on our line of business (one which we invented) and welcomes his payment for Adwords.

Google Sucks. More & more companies are realizing how Google is bringing them down.

This may not be intentional, but after the Penguin update, a lot of small bizes will go out of biz including mine.
